Bernie Sanders, I-Vermont, is pitching a new bill to stop seniors from having money withheld from their <a href=\"https:\/\/www.cnbc.com\/2026\/08\/16\/social-security-john-larson-connecticut-primary.html\">Social Security<\/a> checks due to unpaid federal <a href=\"https:\/\/www.cnbc.com\/student-loans\/\">student loan<\/a> debt.<\/p>\n<p>Sanders <a href=\"https:\/\/www.sanders.senate.gov\/press-releases\/news-sanders-to-introduce-bill-to-stop-trump-from-garnishing-social-security-checks-of-seniors-with-student-debt\" target=\"_blank\">announced the proposal<\/a> on Monday and will formally introduce the bill \u2014 called the Stop Social Security Garnishment Act \u2014 when the Senate is back in session next month, according to a spokesperson for the senator. <\/p>\n<p>The bill is also backed by Democratic Sens. Elizabeth Warren and Ed Markey, both of Massachusetts.<\/p>\n<p>About 9.5 million borrowers are in default on their student loans, according to an Associated Press <a href=\"https:\/\/apnews.com\/article\/student-loan-debt-default-save-fba5642407fc33b579acdbf774a492d3?utm_source=copy&amp;utm_medium=share\" target=\"_blank\">analysis<\/a> of federal data through March. <\/p>\n<\/div>\n<div class=\"group\">\n<div class=\"RelatedContent-relatedContent\" id=\"RegularArticle-RelatedContent-1\">\n<div class=\"RelatedContent-container\">\n<div class=\"RelatedContent-nonCollapsibleContent\">\n<h2 id=\"read-more-cnbc-personal-finance-coverage\" class=\"RelatedContent-header\">Read more CNBC personal finance coverage<\/h2>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>Nearly 1 in 4 borrowers cannot repay their loans and are at risk of having their wages or Social Security checks seized, according to Sanders&#8217; announcement.<\/p>\n<p>Sanders&#8217; proposal comes as the Trump administration has paused involuntary collections for borrowers in default on federal student loans. <\/p>\n<\/div>\n<h2 id=\"whats-happening-with-student-loan-collections\" class=\"ArticleBody-subtitle\"><a id=\"headline0\"\/>What&#8217;s happening with student loan collections<\/h2>\n<div class=\"group\">\n<p>The Trump administration <a href=\"https:\/\/www.cnbc.com\/2025\/06\/02\/trump-pauses-social-security-benefit-cuts-over-defaulted-student-loans.html\">said in June<\/a> 2025 that it would not cut Social Security benefits for affected borrowers, reversing course months after it announced plans to resume collection activity following Covid-era policies that had protected borrowers who had fallen behind. <\/p>\n<p>Then in January, the Education Department <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-delays-involuntary-collections-amid-ongoing-student-loan-repayment-improvements\" target=\"_blank\">said<\/a> it planned to <a href=\"https:\/\/www.cnbc.com\/2026\/01\/16\/student-loan-collections-paused.html\">delay wage garnishment and other involuntary collections<\/a> while it worked to implement new federal student loan repayment options from President <a href=\"https:\/\/www.cnbc.com\/donald-trump\/\">Donald Trump<\/a>&#8216;s &#8220;big beautiful bill.&#8221;<\/p>\n<p>Reforms enacted through the tax law <a href=\"https:\/\/www.cnbc.com\/2026\/04\/19\/college-graduates-face-federal-student-loan-changes.html\">reduced the number<\/a> of repayment plans\u00a0overall and also\u00a0launched two<a href=\"https:\/\/www.cnbc.com\/2026\/05\/29\/student-loan-borrowers-new-repayment-plans.html\"> new repayment options<\/a> starting on July 1. <\/p>\n<\/div>\n<div role=\"region\" aria-labelledby=\"Placeholder-ArticleBody-Video-107290326\">\n<div role=\"button\" tabindex=\"0\" id=\"Placeholder-ArticleBody-Video-107290326\" class=\"PlaceHolder-wrapper\" data-vilynx-id=\"7000313818\" data-test=\"VideoPlaceHolder\">\n<div class=\"InlineVideo-videoEmbed\" id=\"InlineVideo-0\" data-test=\"InlineVideo\">\n<div class=\"InlineVideo-wrapper\">\n<div class=\"InlineVideo-inlineThumbnailContainer\"><span class=\"InlineVideo-videoButton\"\/><span\/><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>For student loan borrowers in default, the delay in collections\u00a0may provide\u00a0time for borrowers to <a href=\"https:\/\/www.cnbc.com\/2025\/05\/17\/student-loan-borrowers-how-to-avoid-delinquency-default-garnishment.html\">rehabilitate their loans<\/a> through repayments and get their loans out of default, the Education Department said in January.<\/p>\n<p>Asked by CNBC about the status of the garnishment pause, an Education Department spokesperson referred to the January announcement. <\/p>\n<\/div>\n<h2 id=\"what-sanders-proposal-may-mean-for-older-borrowers\" class=\"ArticleBody-subtitle\"><a id=\"headline1\"\/>What Sanders&#8217; proposal may mean for older borrowers<\/h2>\n<div class=\"group\">\n<p>Sanders&#8217; proposal would ensure that Social Security retirement or disability benefits are not cut to repay outstanding student loan debt. <\/p>\n<p>Older adults with student loans in default would be protected from forced collection of their benefit checks,\u00a0ensuring they can continue to pay for basic needs\u00a0such as\u00a0healthcare, medicine, and food, according to the proposal.<\/p>\n<\/div>\n<div class=\"group\">\n<p>&#8220;In the richest country in the history of the world, no senior should have their Social Security payments taken away from them to pay back student debt,&#8221;
