But some experts question which workers will benefit from the policy.\u00a0<\/p>\n<p>Enacted via President <a href=\"https:\/\/www.cnbc.com\/donald-trump\/\">Donald Trump<\/a>&#8216;s &#8220;<a href=\"https:\/\/www.cnbc.com\/2025\/07\/03\/trump-big-beautiful-bill-tax-changes.html\">big beautiful bill<\/a>,&#8221; the <a href=\"https:\/\/www.irs.gov\/newsroom\/one-big-beautiful-bill-act-tax-deductions-for-working-americans-and-seniors\" target=\"_blank\">provision<\/a> allows certain workers to deduct up to $25,000 of &#8220;qualified tips&#8221; per year on federal returns from 2025 to 2028. <\/p>\n<p>The tips deduction phases out, or gets smaller, once modified adjusted gross income exceeds $150,000 for single filers or $300,000 for married couples filing jointly.\u00a0\u00a0\u00a0<\/p>\n<\/div>\n<div class=\"group\">\n<div class=\"RelatedContent-relatedContent\" id=\"RegularArticle-RelatedContent-1\">\n<div class=\"RelatedContent-container\">\n<div class=\"RelatedContent-nonCollapsibleContent\">\n<h2 id=\"read-more-cnbc-personal-finance-coverage\" class=\"RelatedContent-header\">Read more CNBC personal finance coverage<\/h2>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>Both Trump and former Vice President <a href=\"https:\/\/www.cnbc.com\/kamala-harris\/\">Kamala Harris<\/a> floated<a href=\"https:\/\/www.cnbc.com\/2024\/08\/13\/trump-and-harris-no-taxes-on-tips.html\"> &#8220;no tax on tips&#8221;<\/a>\u00a0during the 2024 presidential campaign. Republicans enacted the capped deduction via their multi-trillion-dollar <a href=\"https:\/\/www.cnbc.com\/guide\/what-trumps-one-big-beautiful-bill-means-for-your-money\/\">tax-and-spending package<\/a> in early July.<\/p>\n<p>Approximately 6 million workers <a href=\"https:\/\/www.irs.gov\/newsroom\/treasury-irs-provide-guidance-for-individuals-who-received-tips-or-overtime-during-tax-year-2025\" target=\"_blank\">report tipped wages<\/a>, according to IRS estimates released in November.\u00a0But not all tipped workers qualify.<\/p>\n<\/div>\n<h2 id=\"lowest-earners-cant-claim-no-tax-on-tips\" class=\"ArticleBody-subtitle\"><a id=\"headline0\"\/>Lowest earners can&#8217;t claim &#8216;no tax on tips&#8217;<\/h2>\n<div class=\"group\">\n<p>Both parties promoted the &#8220;no tax on tips&#8221; deduction as tax relief for working families. But the country&#8217;s lowest earners may not be able to claim it, experts say.<\/p>\n<p>&#8220;Low-income households do not benefit from no tax on tips because they already don&#8217;t pay federal income tax,&#8221; Elena Patel, co-director of the Urban-Brookings Tax Policy Center, told CNBC.\u00a0<\/p>\n<p>For 2025, workers won&#8217;t owe federal income taxes until earnings exceed the standard deduction, which is $15,750 for single filers or\u00a0$31,500 for married couples filing jointly. Above that, certain tax breaks, such as the\u00a0<a href=\"https:\/\/www.cnbc.com\/2025\/02\/03\/earned-income-tax-credit-eligibility-for-2024.html\">earned income tax credit<\/a>, can also reduce liability below zero.<\/p>\n<\/div>\n<div class=\"group\">\n<p>In 2022, more than one-third of tipped workers, 37%, <a href=\"https:\/\/budgetlab.yale.edu\/news\/240624\/no-tax-tips-act-background-tipped-workers\" target=\"_blank\">owed no federal income tax<\/a> due to low income, according to a 2024 report from The Budget Lab at Yale, a non-partisan policy research center. <\/p>\n<p>An analysis from the Tax Policy Center, a non-partisan think tank, showed similar findings. If tips were tax-free or tax-exempt, <a href=\"hhttps:\/\/taxpolicycenter.org\/fiscal-facts\/tax-free-tips-how-would-they-impact-tipped-workers\" target=\"_blank\">only about 60%<\/a> of tipped workers would benefit, the organization reported in early 2025.<\/p>\n<\/div>\n<div role=\"region\" aria-labelledby=\"Placeholder-ArticleBody-Video-108244761\">\n<div role=\"button\" tabindex=\"0\" id=\"Placeholder-ArticleBody-Video-108244761\" class=\"PlaceHolder-wrapper\" data-vilynx-id=\"7000399133\" data-test=\"VideoPlaceHolder\">\n<div class=\"InlineVideo-videoEmbed\" id=\"InlineVideo-0\" data-test=\"InlineVideo\">\n<div class=\"InlineVideo-wrapper\">\n<div class=\"InlineVideo-inlineThumbnailContainer\"><span class=\"InlineVideo-videoButton\"\/><span\/><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<h2 id=\"some-tipped-workers-wont-qualify\" class=\"ArticleBody-subtitle\"><a id=\"headline1\"\/>Some tipped workers won&#8217;t qualify <\/h2>\n<div class=\"group\">\n<p>Since the policy was first introduced, there have been questions about which occupations qualify for the &#8220;no tax on tips&#8221; deduction. <\/p>\n<p>The Treasury Department and IRS released a <a href=\"https:\/\/www.cnbc.com\/2025\/09\/10\/no-tax-on-tips-deduction-who-qualifies.html\">preliminary list of jobs<\/a> in September. But certain workers who receive tips via a so-called &#8220;<a href=\"https:\/\/www.aicpa-cima.com\/resources\/download\/specified-service-trade-or-business-list-sstbs\" target=\"_blank\">specified service trade or businesses<\/a>,&#8221; or SSTBs, from industries including health care, legal, financial services, performing arts and others, are not eligible for the tax break.\u00a0<\/p>\n<p>However, SSTB workers may be able to <a href=\"https:\/\/www.cnbc.com\/2025\/11\/25\/irs-guidance-trump-tips-overtime-deductions.html\">temporarily claim<\/a> the deduction for 2025 until the Treasury and IRS finalize regulations, based on <a href=\"https:\/\/www.irs.gov\/pub\/irs-drop\/n-25-69.pdf\" target=\"_blank\">&#8220;transition relief&#8221;<\/a> released by the agencies in November.\u00a0\u00a0<\/p>\n<p>With lingering uncertainty about eligibility, &#8220;it&#8217;s possible to confuse people into thinking they will qualify for this for future years,&#8221; said Garrett Watson, director of policy analysis at the Tax Foundation. <\/p>\n<\/div>\n<\/div>\n\n<br \/><a href=\"https:\/\/www.cnbc.com\/2025\/12\/23\/no-tax-on-tips-who-benefits.html\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"A Starbucks barista demonstrates how to brew coffee using a siphon at the Reserve Store in Seattle.
