The Big Tech firm had argued that the works had been used to develop a transformative technology, which was fair \u201cirrespective\u201d of how it acquired the works. <\/p>\n<p>This case is among dozens of legal battles working their way through the courts, as creators seek greater financial rights when their works are used to train <a href=\"https:\/\/www.ft.com\/artificial-intelligence\" data-trackable=\"link\">AI<\/a> models that may disrupt their livelihoods \u2014 while companies profit from the technology.<\/p>\n<p>However, Chhabria warned that his decision reflected the authors\u2019 failure to properly make their case.<\/p>\n<p>\u201cThis ruling does not stand for the proposition that Meta\u2019s use of copyrighted materials to train its language models is lawful,\u201d he said. \u201cIt stands only for the proposition that these plaintiffs made the wrong arguments and failed to develop a record in support of the right one.\u201d<\/p>\n<p>It is the second victory in a week for tech groups that develop AI, after a federal judge on Monday ruled in favour of San Francisco start-up Anthropic in a similar case.<\/p>\n<p>Anthropic had trained its Claude models on legally purchased physical books that were cut up and manually scanned, which the ruling said constituted \u201cfair use\u201d. However, the judge added that there would need to be a separate trial for claims that it pirated millions of books digitally for training.<\/p>\n<p>The Meta case dealt with LibGen, a so-called online shadow library that hosts much of its content without permission from the rights holders.<\/p>\n<aside aria-labelledby=\"aside-label\" class=\"n-content-recommended--single-story n-content-recommended--inset\" data-component=\"recommended\">\n<p class=\"n-content-recommended__title o3-type-body-highlight\">Recommended<\/p>\n<div class=\"o-teaser o-teaser--article o-teaser--small o-teaser--stacked o-teaser--has-image o-teaser--opinion js-teaser\" data-id=\"9751cbe5-e560-4f1a-82ea-9a5899c135a6\">\n<div class=\"o-teaser__image-container js-teaser-image-container\"><a href=\"https:\/\/www.ft.com\/content\/9751cbe5-e560-4f1a-82ea-9a5899c135a6\" data-trackable=\"image-link\" data-trackable-context-story-link=\"image-link\" tabindex=\"-1\" aria-hidden=\"true\"><\/p>\n<div class=\"o-teaser__image-placeholder\" style=\"aspect-ratio:2400\/1350\"><\/div>\n<p><\/a><\/div>\n<\/div>\n<\/aside>\n<p>Chhabria suggested a \u201cpotentially winning argument\u201d in the Meta case would be market dilution, referring to the damage caused to copyright holders by AI products that could \u201cflood the market with endless amounts of images, songs, articles, books, and more\u201d.<\/p>\n<p>\u201cPeople can prompt generative AI models to produce these outputs using a tiny fraction of the time and creativity that would otherwise be required,\u201d Chhabria added.
