It threatens an emerging industry based on weaponising tiny vulnerabilities for huge profits.<\/p>\n<p>\u201cToday\u2019s verdict in WhatsApp\u2019s case is an important step forward for privacy and security as the first victory against the development and use of illegal spyware that threatens the safety and privacy of everyone,\u201d <a href=\"https:\/\/www.ft.com\/stream\/7b5b19ff-e034-4c9a-96f7-c3aab7c47f05\" data-trackable=\"link\">WhatsApp<\/a> parent company Meta said in a blog post.<\/p>\n<p><a href=\"https:\/\/www.ft.com\/stream\/6b101ef2-9145-4599-be5c-9235e8f8dcc3\" data-trackable=\"link\">NSO<\/a> said it would appeal. \u201cWe firmly believe that our technology plays a critical role in preventing serious crime and terrorism and is deployed responsibly by authorised government agencies,\u201d it said in a statement.<\/p>\n<p>Meta-owned WhatsApp\u2019s success in the case opens NSO up to litigation from Apple, Amazon, Android and other global companies whose platforms Pegasus either abused, or attempted to hack, in order to inject its spyware.<\/p>\n<p>\u201cAfter years of every trick and delay tactic it only took the jury a day\u2019s deliberation to see right through to the heart of the matter: NSO\u2019s business is based on hacking American companies\u2009.\u2009.\u2009.\u2009so that dictators can hack dissidents,\u201d said John Scott-Railton at the University of Toronto\u2019s Citizen Lab, a watchdog group, which helped WhatsApp investigate the hack and protect the civil society targets.<\/p>\n<p>The world\u2019s largest technology companies backed WhatsApp\u2019s lawsuit, filing legal briefs in support.<\/p>\n<p>Pegasus was considered a pioneer in an industry that bloomed \u2014 mostly within Israel \u2014 for nearly a decade. It commercialised weaknesses in popular software, enabling clients to penetrate the privacy of smartphones anywhere in the world \u2014 bypassing encryption and even remotely activating handheld microphones and cameras to capture private conversations.<\/p>\n<p>NSO initially operated in the shadows, staffed by veterans of the Israeli military\u2019s signals intelligence units, who were paid hundreds of thousands of dollars a year to create software that mimicked the technical capabilities of Israel\u2019s military.<\/p>\n<p>It was valued at more than $1bn in a private equity buyout in 2019, and reported $251mn in revenues in 2018.<\/p>\n<p>The sale of Pegasus was considered a diplomatic calling card to prise open relations between the Jewish state and its Gulf rivals, with NSO signing blockbuster deals with countries that had a record of human rights abuses, including Saudi Arabia and the UAE, which did not recognise Israel at the time.<\/p>\n<p>In 2019, <a href=\"https:\/\/www.ft.com\/content\/4da1117e-756c-11e9-be7d-6d846537acab\" data-trackable=\"link\">the Financial Times reported<\/a> that NSO was exploiting a weakness in WhatsApp that allowed its clients to make a single missed call to a target\u2019s phone, which would then install the spyware \u2014 allowing the device to be operated remotely, deleting the phone call and exposing all its contents, from pictures to location history.<\/p>\n<p>WhatsApp fixed the leak, but also studied the traces that Pegasus left, finally identifying hundreds of targets that it notified of the hack, including at least 100 people considered members of civil society \u2014 human rights lawyers, advocates for press freedom and prominent opposition politicians.<\/p>\n<p>Before this database was generated by WhatsApp, which worked with Citizen Lab, NSO had argued that its software was being sold to responsible clients, who were contract-bound to use it only to prevent crime and terrorism, and that any abuse was rare.<\/p>\n<aside aria-labelledby=\"aside-label\" class=\"n-content-recommended--single-story n-content-recommended--inset\" data-component=\"recommended\">\n<p class=\"n-content-recommended__title o3-type-body-highlight\">Recommended<\/p>\n<div class=\"o-teaser o-teaser--article o-teaser--small o-teaser--stacked o-teaser--has-image js-teaser\" data-id=\"e5b770d7-07af-4e27-a686-a0c473e93770\">\n<div class=\"o-teaser__image-container js-teaser-image-container\"><a href=\"https:\/\/www.ft.com\/content\/e5b770d7-07af-4e27-a686-a0c473e93770\" data-trackable=\"image-link\" data-trackable-context-story-link=\"image-link\" tabindex=\"-1\" aria-hidden=\"true\"><\/p>\n<div class=\"o-teaser__image-placeholder\" style=\"aspect-ratio:2270\/1277\"><\/div>\n<p><\/a><\/div>\n<\/div>\n<\/aside>\n<p>\u201cThen WhatsApp showed up and it was like the playground bully suddenly met their match, said Scott-Railton. \u201cWhatsApp stuck the fight out and carried this case across the finish line\u2009.\u2009.\u2009.\u2009a huge credit to their leadership for carrying this torch.\u201d<\/p>\n<p>But the extent of abuse unveiled in the investigation put the spotlight on NSO and its rivals, drawing the attention of media consortiums and the Biden administration, which blacklisted NSO and sought to regulate the spyware industry.<\/p>\n<p>The Meta-owned company also decided to sue NSO, vowing to make public everything its lawyers discovered about the company\u2019s inner workings, while seeking to hold it responsible for the hack.<\/p>\n<p>The jury trial was focused exclusively on damages.
